MARTIN ATHLETIC TRAINING LIABILITY WAIVER AND RELEASE OF CLAIMS
PLEASE READ CAREFULLY – THIS IS A LEGAL DOCUMENT
1. Acknowledgment of Risk
I, the undersigned participant, acknowledge and understand that I am 18 years of age or older and that participation in fitness activities, strength and conditioning programs, personal training, group classes, and general use of the facilities and equipment at Martin Athletic Training (“the Gym”) involves inherent risks. These risks may include, but are not limited to: muscle strains, sprains, cardiovascular complications, orthopedic injuries, paralysis, or death, as well as risks arising from the use or misuse of equipment, collisions with other participants, and environmental conditions.
I fully assume all such risks, known and unknown, foreseeable or unforeseeable, and accept full responsibility for my participation.
2. Waiver, Release, and Hold Harmless Agreement
In consideration for being permitted to enter, use, and participate in any activities at the Gym, I hereby release, waive, discharge, and covenant not to sue Martin Athletic Training, its officers, directors, owners, employees, independent contractors, volunteers, agents, representatives, successors, and assigns (collectively, “Released Parties”) from any and all present or future claims, demands, causes of action, damages, costs, or expenses, whether known or unknown, arising out of or relating to my participation in Gym activities, including but not limited to personal injury, illness, property damage, economic loss, or death.
3. Indemnification and Defense
I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, causes of action, damages, judgments, losses, liabilities, and expenses (including attorney’s fees and costs) arising out of or resulting from my actions, omissions, or participation in any Gym activities or use of the facilities and equipment.
4. Medical Disclaimer and Fitness to Participate
I certify that I am in good physical condition and have received medical clearance from a licensed physician to engage in physical fitness activities. I understand that the Gym does not provide medical treatment, evaluation, or supervision and that in the event of a medical emergency, staff may call for emergency services at their discretion but are not obligated to do so. I am solely responsible for monitoring my physical condition and seeking medical attention as needed.
5. Health Disclosures and Personal Responsibility
I agree to promptly disclose any known or suspected medical conditions, injuries, or other health-related concerns that may affect my safe participation in Gym activities to staff or trainers. I acknowledge that failure to communicate such information may increase my risk of injury.
6. Rules, Conduct, and Use of Equipment
I agree to abide by all posted rules, guidelines, safety protocols, and verbal instructions given by staff. I agree to use all equipment and facilities in a responsible manner and only for their intended purposes. I will seek assistance from qualified personnel if I am unsure how to use any equipment properly.
7. Photo and Video Release
I grant Martin Athletic Training permission to take and use photographs, video recordings, and other media of me while on Gym premises for promotional, marketing, social media, or educational purposes, without compensation or notification. If I do not consent, I understand that I must notify the Gym in writing prior to participation.
8. Severability and Governing Law
If any portion of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. This agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws rules.
9. Acknowledgment of Understanding and Voluntary Agreement
I have read this waiver in its entirety and understand its contents. I understand that by signing this document, I am giving up substantial legal rights, including the right to sue. I acknowledge that I am signing this agreement freely and voluntarily, and intend for it to be a complete and unconditional release of all liability to the greatest extent allowed by law.
